These terms and conditions (collectively, hereinafter referred to as the "Terms") govern your ("User") access to and use of the website, www.inlancarry.com and the inlancarry mobile applications ("Website"). The Website is owned, managed and operated by Apolaki Logistics and Hospitality Private Limited ("inlancarry").

Please read these Terms carefully before using the Website, which is an online marketplace. For the purpose of clarity, it is hereby stated that the Website is not engaged in providing any services by itself but is a platform, which merely connects the fleet operators / Vehicle owner with the users.

These Terms are an electronic record in terms of the applicable legislation. This electronic record is generated by a computer system and does not require any physical or digital signatures. By using the Website, you signify your agreement to be bound by these Terms.

PLEASE NOTE THAT YOUR USE OF THE WEBSITE IN ANY WAY SIGNIFIES YOUR ACCEPTANCE TO THE TERMS. By agreeing to these Terms, You also agree to inlancarry' other Website policies; including but not limited to, (i) Privacy Policy, as amended from time to time; and (ii) Cookie Policy.

In addition to these Terms, any other ‘terms of service’ of the application-programming interface ( “API” ) with which inlancarry may tie-up would form an integral part of these Terms (hereinafter referred to as the “API Terms” ). However, in the event of a conflict between such API Terms and these Terms, these Terms provided herein shall prevail.

Both You and inlancarry are individually referred to as 'Party' and collective referred to as 'Parties', in these Terms.

Terminology:

For the purpose of these Terms, wherever the context so requires "You" or "User" (would mean 'inlancarry user') shall mean any natural or legal person who has agreed to become a buyer of the service and/or an availer of the Facility being offered on the Website.

The term "We", "Us", "Our" shall mean inlancarry and/or its affiliates.

Inlancarry.com is associated with a massive network of fleet owners/ operators with proven capacities. Currently we offer services to connect fleet operator / vehicle owner with users to connect all major routes across India and continuously adding further destinations from time to time.

The Company provides Services and you agree to obtain such services offered by the Company. The Company shall take your booking request (through the internet and / or mobile telecommunications devices). Company shall have the sole discretion to accept or reject each request for Services. If the Company accepts the booking request made by the User, a confirmation will be generated and User will be notified accordingly. The Company shall make reasonable efforts to provide Services subject to availability of the resources in or around your location at the time of your booking request made to the Company.

Users are advised to take appropriate transit insurance for the goods/product that the users intent to be transporting in order to protect their own interests. The Company will provide necessary support with regard to transaction documents of services to the User in case of insurance claims are lodged by the user with the insurance company. The User shall ensure that he/she will not indulge in any of the following activities while availing the Service: Soiling or damaging the body and/or any other interiors of the mini-truck/tempo/vehicle. Misusing, spoiling or damaging any of the devices (technical/non-technical) in the truck/tempo/vehicle. Asking the driver to break any Traffic/RTO/City Police and/or government rules for any purpose. The driver has the right to refuse such a request by the User. The driver also has the right to refuse such a pick-up. Pressurizing the driver to overload truck/tempo/vehicle with the consignment than the allowed limit. Not disclosing the correct contents of goods/materials which are to be sent through the Service. The User undertakes that it has made the declaration of goods/materials for the consignment correctly and that there is no information which is concealed at the time of booking of the Services. The User certifies that all statements and information provided relating to the transportation of the consignment will be true and correct. User acknowledges that in the event that user makes an untrue or fraudulent statement about the consignment or any of its contents user risks a civil claim and/or criminal prosecution, the penalties for which include forfeiture and sale of the consignment. To the extent that Company may voluntarily assist the user in completing the required customs and other formalities(if required) such assistance will be rendered at user’s sole risk. User agrees to indemnify the Company and hold it harmless from any claims that may be brought against the Company arising from the information that user has provided to the Company and any costs the Company will incur regarding this, and pay any administration fee that Company may charge the user for providing the services described in this condition.

In light of the foregoing, you agree that any liability in relation to any services being offered on the Website in accordance with the applicable laws shall be that of the Fleet operator / vehicle owner and not inlancarry. In case of any deficiency of service, you agree to pursue any such action arising from such deficiency of service against the Fleet operator / vehicle owner and not the inlancarry.

You further agree and acknowledge that the inlancarry is only a facilitator and is not and cannot be a party to or control in any manner any transactions on the Website. Accordingly, the contract of sale of services on the Website shall be a strictly bipartite contract between you and the Fleet operator / vehicle owner listed on the Website.

Maintenance and System Failure:

While inlancarry.com shall take all reasonable efforts for data backup and business resumption, you will be solely reasonable for retaining back-up copies of all information, photography and other materials furnished / submitted to www.inlancarry.com. Inlancarry.com may also suspend the operation of inlancarry.com for support or technical up-gradation, maintenance work, in order to update the content or for any other reason. Your use of this website and any dispute arising out of such use of the website is subjected to the laws of India or other regulatory authority.

In no circumstances whatsoever shall the company be liable to the customer or the owner for any loss, damage, cost or expenses arising out of any person(s) relaying advice or information.

The company reserves the right to disable the accounts of users who breach these terms without notice and without refund.
